Wills, Trusts and Probate Solicitors

At David & Durn Co in Ruislip, we understand that the time following the death of a loved one can be emotional and difficult. Therefore, we focus on providing clear and sympathetic advice and assistance.

We are experienced with all types of probate and estate administration of various size and complexity. We can assist executors in applying for a grant of probate. We also represent those wishing to administer an estate that is intestate (without a will) in applying for letters of administration. This can include:

  • The valuing and collecting in of assets
  • Completing HMRC tax accounts
  • Tracing beneficiaries
  • Transferring property
  • Drafting deeds of variation
  • Preparing all estate accounts

Our firm also represents clients involved in contentious probate or will disputes. If you believe your loved one's estate was unfairly divided, or his or her instruction had been unduly influenced by an outside party, we can help you determine your options for seeking legal recourse, including court representation.

Protecting Assets Through Wills, Trusts and Lifetime Planning

Our solicitors also provide advice on how to protect assets should something unexpected happen to you. We provide advice and assistance with:

  • Wills — A will is an effective way to ensure your assets are dealt with according to your wishes. It can also be used to decide who will be responsible for your estate upon your death; appoint guardians for your children whilst they are under 18; leave gifts for friends, family or charities; and specify your funeral wishes.
  • Trusts — Our firm offers inheritance tax planning and advice of setting up trusts to minimise inheritance tax liability. Working with you, we will review your estate, listen to your goals and put the necessary provisions in place to maximise your asset protection.
  • Lasting Powers of Attorney (LPA) — There are two types of lasting powers of attorney. The Property and Financial Affairs LPA will manage your property and material assets, and make decisions in your best interests. The Health and Welfare LPA will make decisions on your behalf when you lack the mental capacity to do so, including decisions on medical care or whether you should live in a care home.

We recommend that everyone over the age of 18 at least makes a will. Without one, the laws of intestacy will apply, which do not take your personal wishes into account. For example, under current rules, only the first £325,000 of your estate will pass to a spouse or civil partner. Anything over this amount, despite your wishes, will not automatically transfer if you do not create additional provisions in a valid will.

Once the will has been signed, our firm will store it free of charge in our secure and fire-proof storage and provide you with copies.
